J&K High Court affirms detention of main accused in Srinagar DySP lynching case
The Jammu and Kashmir High Court has upheld the preventive detention of a man who is the main accused in the 2017 DySP lynching case that occurred in Srinagar’s Nowhatta area. The incident involved the lynching of a Deputy Superintendent of Police by a mob outside Jamia Masjid during a large gathering on the eve of Shab-i-Qadr.
The petitioner, Imran Nabi Wani, had challenged the detention order, claiming that he was granted bail in the lynching case. However, the court stated that preventive detention can be ordered if there are compelling reasons to believe that the person might be released on bail or due to acquittal or discharge in the substantive offence.
The court emphasized that preventive detention aims to protect society and rejected the petitioner’s claim of not receiving relevant material for effective representation, stating that he was provided with all necessary documents.
In its decision, the court highlighted the brutality of the attack on the DySP and dismissed the petition, finding it devoid of merit.
