Caste certificate case: Transgender Councillor Bobi Kinnar gets interim protection from arrest till Tuesday
New Delhi [India], August 24 (ANI): Transgender MCD Councillor Bobi Kinnar has been granted interim protection from arrest till Tuesday in an FIR registered against Kinnar for allegedly submitting a forged caste certificate to contest in the reserved women’s SC seat in Sulatanpuri ward during the MCD election 2022.
Bobi Kinnar has moved an application for anticipatory bail.
Additional Sessions Judge (ASJ) Kapil Kumar directed the Investigation Officer to appear physically on Tuesday to file a reply.
Given the submission of the IO that he is on leave and will file the reply on Tuesday, the court has granted interim protection from arrest to Bobi Kinnar till Tuesday.
The court noted in the order that IO appeared through video conferencing and submitted that he would verify the caste certificate of the Kinnar and thereafter take necessary steps as per law.
The IO also submitted that he would not arrest Bobi Kinnar till Tuesday.
Advocate Amit Kumar who appeared for MCD Councillor claimed that a false FIR had been registered by the complainant by misusing the process of law.
It was also submitted that a complaint had been filed against the complainant. The concerned court has opined to initiate an inquiry.
An FIR was registered against Bobi Kinnar on the complaint filed by Congress candidate Varuna Dhaka. It was alleged that Kinnar used a forged/fabricated caste certificate to contest the MCD election 2022. Dhaka had lost the election.
